  1. Acceptance: By participating in gaming activities, attending events, or visiting Century Downs Racetrack Casino (the "Facility"), you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.

    • "Racing" means live Standardbred racing events.
    • "Casino Gaming" refers to gaming activities on the Facility's casino floor.
    • "Visitors" includes anyone visiting or attending the Facility for any purpose, including guests of patrons.
    • "Operators" refers to Century Downs Racetrack Casino and its employees.
  3. Responsibility:The Operators are not responsible for damages or losses resulting from the use of their facilities or services by visitors. Visitors shall hold harmless the Operators, their officers, directors, agents, and employees against all claims, demands, actions, causes of action, costs, expenses (including reasonable attorneys' fees), debts, obligations, and liabilities arising out of any occurrence related to their attendance at the Facility.

  4. Liability:Visitors acknowledge that they participate in racing or casino gaming activities entirely at their own risk. The Operators shall not be liable for injury, loss, damage, or death resulting from accidents, occurrences, or other events which may arise during participation in any activity within the Facility.

  5. Conduct and Prohibited Activities:Visitors must conduct themselves in a lawful, orderly, and respectful manner at all times while on the premises of the Facility. The following activities are prohibited:

a) No person under 18 years old shall participate in racing or casino gaming.b) Visitors with self-exclusion orders cannot enter the Facility.c) Prohibited items: weapons, electronic devices (except for personal use), and other unauthorized materials.

  1. Compliance:Visitors must comply with all applicable laws, regulations, rules, and instructions provided by facility staff while on the premises of the Facility.

  2. Gambling Limitations:All gaming activities are subject to provincial jurisdiction regarding wagering limits and responsible gambling practices.

  3. Intellectual Property Rights:The Operators reserve all proprietary rights to their name, branding, logos, intellectual property, trade secrets, copyrights, trademarks, or other proprietary materials used within the Facility.

  4. Amendments & Termination:These Terms and Conditions may be amended at any time without notice by posting revised terms on the facility's website or otherwise making them known to visitors. The Operators reserve the right to terminate this agreement immediately if you fail to comply with these Terms and Conditions.

  5. Governing Law:These Terms and Conditions shall be governed, construed, and enforced in accordance with all applicable federal, provincial, and local laws of Canada without reference to any conflict of law principles or rules that would cause the application of the laws of another jurisdiction.

  6. Waiver & Indemnification:By using these services, you agree to waive any claims for damages arising out of or related to your use. The Operators shall be indemnified against all expenses and costs incurred as a result of any claim made by third parties due to breaches committed by visitors.

  7. Jurisdiction & Dispute Resolution:Any disputes arising under or in connection with these Terms and Conditions shall be resolved exclusively through the courts having jurisdiction within the province where the Facility is located, without regard for conflicts-of-law rules that might cause application of laws from another jurisdiction.

  8. Entire Agreement:These Terms and Conditions represent a complete understanding between the parties regarding their relationship and shall supersede any prior or contemporaneous agreements.

  9. Severability & Construction:If one term is found to be invalid, it will not affect other terms in these conditions. The language used in this agreement has been chosen for clarity rather than brevity; no ambiguity must necessarily follow the wording of individual clauses but every effort shall be taken by both parties to understand their intent as agreed.

  10. Changes:Any change or modification made by one party will not apply unless both acknowledge in writing that an amendment was accepted at a specified date and time; all changes are therefore subject to approval prior to implementation.

  11. Applicable Laws & Regulations:All applicable federal, provincial, municipal laws (and any other related regulations) govern the Facility's operations; failure to adhere will be considered non-compliance which may lead to liability according to their provisions.

  12. Notice:By entering this agreement you agree to receive necessary notifications regarding terms revisions through mail or electronic means used for official announcements made by management at their discretion without obligation to inform of updates beyond what has been established within these Terms Conditions.

  13. Definitions and Interpretation:In these conditions, words such as "shall", "will" are interpreted according to the principles that apply in Canadian law; ambiguities shall be resolved against the party most likely responsible under prevailing legislation.

  14. Limitations of Liability:

Operators provide services 'as is' with no guarantee or warranties express or implied and exclude all liability for any loss, damage (including indirect consequential losses), expense, cost, claim which may arise from our provision; exceptions to this non-liability apply in areas such as product defects only.

Notices:By accepting these terms you consent that notices given electronically via email will be sufficient for serving legal communications regarding changes within the Terms & Conditions, or otherwise requiring immediate action based upon updated information published online by management without obligation towards postal services beyond this format chosen due primarily ease of communication efficiency through modern electronic channels now widely accepted across various business sectors.
